By accessing and using Gijima ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you do not have permission to access the Service.

These Terms apply to all visitors, users, and others who access or use the Service, including but not limited to registered athletes, coaches, and team administrators.

2. Use of Our Service

Account Creation

When you create an account with us, you must provide information that is accurate, complete, and current at all times. You are responsible for safeguarding the password and for all activities that occur under your account.

Acceptable Use

You may not use our Service:

• For any unlawful purpose or to solicit others to perform unlawful acts
• To violate any international, federal, provincial, or state regulations, rules, laws, or local ordinances
• To infringe upon or violate our intellectual property rights or the intellectual property rights of others
• To harass, abuse, insult, harm, defame, slander, disparage, intimidate, or discriminate
• To submit false or misleading information
• To upload or transmit viruses or any other type of malicious code

3. Subscription Plans and Billing

Subscription Terms

Gijima offers subscription-based services with different tiers: Solo ($25/month), Coach ($40/month), and Team ($179/month). Each tier provides specific features and capabilities as described on our pricing page.

Billing and Cancellation

Subscriptions are billed on a recurring monthly or annual basis. You may cancel your subscription at any time through your account settings. Cancellation will take effect at the end of the current billing period.

We reserve the right to modify our subscription plans and pricing at any time. Changes to pricing will not affect existing subscriptions until the next renewal period.

4. Data and Privacy

Your use of our Service is also governed by our Privacy Policy. By using Gijima, you consent to our collection and use of your training data, including but not limited to running activities, heart rate data, pace, distance, and other fitness metrics.

You retain ownership of your training data. We use this data solely to provide and improve our Service, including generating AI-powered insights and recommendations.

5. Third-Party Integrations

Our Service integrates with third-party platforms such as Strava. When you connect these services, you authorize us to access and retrieve your data from these platforms in accordance with their terms of service.

We are not responsible for the practices of third-party services. We encourage you to review their terms and privacy policies.

6. Intellectual Property

The Service and its original content, features, and functionality are and will remain the exclusive property of Gijima and its licensors. The Service is protected by copyright, trademark, and other laws.

Our trademarks and trade dress may not be used in connection with any product or service without our prior written consent.

7. Disclaimer and Limitation of Liability

Gijima provides training insights and recommendations based on your data. However, this information is not a substitute for professional medical advice. Always consult with qualified health professionals before making changes to your training regimen.

Service Disclaimer

The Service is provided "as is" and "as available" without any warranties, expressed or implied. We do not warrant that the Service will be uninterrupted, secure, or error-free.

Limitation of Liability

To the maximum extent permitted by law, Gijima shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use or inability to use the Service.

8. Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason, including without limitation if you breach the Terms.

Upon termination, your right to use the Service will cease immediately. All provisions of the Terms which by their nature should survive termination shall survive termination.

9. Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days notice prior to any new terms taking effect.

By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.
